In recent weeks it has felt like we are actors in a bad movie. Something does not feel right. Something is just off. Schools are closed. Restaurants are closed. Shopping malls are closed. Libraries are closed. People are afraid to look at each other when in the store. We can't visit our grandma in the nursing home. We dare not need to go to the emergency room. God forbid that we need a colonoscopy. No one is hugging any more. No handshakes are allowed. They said our hospitals would be full, but our hospitals are empty. You feel like something is wrong, because SOMETHING IS WRONG. THE WORLD IS UPSIDE DOWN. THERE IS SOMETHING GOING ON AND YOU NEED TO PAY ATTENTION. WE ARE IN TROUBLE IF WE DON'T TAKE ACTION NOW.

REDUNDANCY. It matters. You look for it in policy. You look for the same words in rules and proposed rules. You look for it when you are trying to figure out what is going on. Matching words matter.
LET US EXPLAIN AND POINT OUT SOME IMPORTANT WORDS THAT SHOULD CONCERN YOU AS PART OF DOCUMENTS THAT GIVE CERTAIN PEOPLE TOO MUCH POWER THAT SHOULD NOT HAVE POWER IN THE STATE OF MISSOURI.
PAY ATTENTION TO REDUNDANCY IN TIMES OF CRISIS. Like an old tired song, those words will start to echo in your head and you will start to understand if you put them into context.
Let us look at a proposed rule that was introduced by the Missouri Department of Health and Senior Services on May 1, 2020.
First know this: The Department of Health and Senior Services (DHSS) is like the Health Department of the State. At the federal level it is called the Department of Health and Human Services (DHHS). The DHSS (state level) informs all county health departments. However, county health departments do not have "police powers." While they do authorize licensing for many different types of businesses, the county health directors typically are not an elected position. It is an appointed position. The same is true of the STATE DIRECTOR OF THE DEPARTMENT OF HEALTH AND SENIOR SERVICES. THE GOVERNOR APPOINTS THAT POSITION.
Pay attention to the rule promulgated by the DHSS in Missouri. NOTE THAT IT IS AN EMERGENCY RULE.

PURPOSE: This rule provides for the isolation or quarantine of persons and animals with a communicable disease and their contacts; it also authorizes the closing of schools and places of public and private assembly as well as the issuance of gathering orders.
So, this rule acknowledges that there is a difference between quarantine and isolation. Ask yourselves, "what is the difference?" There is a difference. But, how does the state interpret this? What does that word "isolate" mean?
Ask this: How does the state plan to trace my contacts? How can they know who I have come in contact with? How will they enforce this?
Ask this: How do they isolate me? Why would they isolate me? Where would they isolate me?
EXAMPLE OF HOW THIS RULE POTENTIALLY LOOKS:
You attend a church service. Everyone is careful. Social distancing is honored. You don't shake hands with anyone. You don't hug. You just quietly attend the service. However, before you are "allowed" to attend that service you have to sign in and agree to contact tracing. You have to do this because the "designated representative" of the appointed director of the DHSS has mandated that you MUST register to attend any service. It is now a state wide rule.
Seem far fetched? Look at Kansas City, MO.

What did they start doing in Nazi Germany? They started targeting people. They started to collect their names and their data so that they knew who they were and where they’ve been.”
(Update: The KC Mayor did alter the order and made it a suggestion due to applied public pressure.)
(Back to the example): You don't know who the designated representative appointed by the appointed director of the DHSS is, but due to their potentially evolving rules and definitions, your life could be dramatically impacted and changed forever.
In order to shop for groceries, attend a church service, or work as a licensed person, you must comply. You have no choice.
Later that day after attending church, you are notified that you have come in contact with someone who has tested positive for COVID-19. You are told you must quarantine or submit to testing for the safety of public health. You can't afford to miss any more work and don't feel sick, so you agree to testing.
Tests are brought to your home by community health workers otherwise known as "Contact Tracers." You and your entire family is tested. You are the only one who tests positive. You are told you must be removed from the household to "isolate" until your test is negative.
You have zero symptoms; you feel great. But, your test is positive. You have no idea how that is possible. You are told you are sick, yet you exhibit no symptoms.
Later that day, two men in a uniform show up to take you away. No one tells you where you are going or how long you will be gone.
It is for public health.

Listen at 3:00 minute mark to Ophelia Dahl, director and co-founder of Partners in Health: "It includes really dignified isolation and treatment of everyone who is sick, and it is ensuring that everyone can be quarantined and at times separated in a very supportive way."
*REMEMBER: The World Health Organization (WHO) and the Center for Disease Control (CDC) are informing the federal and state authorities in their decision making regarding how to manage this time of "crisis."*
Proposed Missouri DHSS RULE continued:
The purpose of limiting the size of public gatherings is to help “flatten the curve,” an approach recommended by multiple health and scientific organizations for slowing the rate of COVID-19 infections. Slowing infection rates helps prevent medical providers from becoming overloaded and reaching a point where they can no longer provide treatment to all those infected. Due to its severity and the rapid increase in the number of cases of COVID-19 infec-tions and potential deaths to Missouri citizens.
NO CURVE TO FLATTEN. WHAT IS GOING ON? OUR HOSPITALS ARE EMPTY AND COLLAPSING AROUND US DUE TO THESE EXTREME RULES. EVIDENCED BY THIS HAPPENING IN MISSOURI RIGHT NOW:

ST. MARY'S HEALTH SYSTEMS:
Curve is flat. Hospitals are in a state of collapsing.
Proposed Missouri DHSS Rule continued:
(3) The local health authority, the director of the Department of Health and Senior Services or the director’s designated representative is empowered to close any public or private school or other place of public or private assembly when, in the opinion of the local health authority, the director of the Department of Health and Senior Services or the director’s designated representative, the closing is necessary to protect the public health. However, in a statewide pandemic, as established by [only] the director of the Department of Health and Senior Services or the director’s designated representative, such individual shall have the authority to close a public or private school or other place of public or private assembly. The director or designated representative shall consult with the local health authorities prior to any such closing. Any school or other place of public or private assembly that is ordered closed shall not reopen until permitted by whomever ordered the closure.
Did you catch that? "OR the director's designated representative." Who will that be? This means that the appointed DHSS director can turn around and appoint an unelected person who has the authority to close any public or private gathering (like churches or private parties) AND... those public AND PRIVATE gatherings CANNOT OPEN UNTIL WHOMEVER ORDERED THEM CLOSED PERMITS THEM TO REOPEN! Who will that be? How do they decide when it is time to reopen?
That means the APPOINTED BUREAUCRAT can appoint another bureaucrat to control the whole entire state! Not your elected governor. Not your elected legislature. A BUREAUCRAT twice removed will decide what and who closes and (I quote) "Any place of public or private assembly that is ordered closed shall not reopen until permitted by whomever ordered the closure". That means you will not have elected that person who closed down our state.

(4) The director of the Department of Health and Senior Services or the director’s designated representative may issue an order limiting public gathering to a certain number of people as established by order, when, in the opinion of such person, such limitation is necessary to protect the public health. For the purpose of this rule, the term “gathering” shall mean any planned or spontaneous event or convening that would bring together more than the established number of people in a single space at the same time.
INTERPRETATION: The bureaucrat twice removed, that you did not elect, can decide by issuing an order how many people can gather together at one time. They can use their "opinion" to limit ANY GATHERING even a "spontaneous gathering." Thus, the bureaucrat twice removed will have unfettered control over all of us, and at their full discretion decide who, how many, where, and when Missourians can gather.
That could be anything. THAT person decides. And that is NOT American.
We are stuck with the emergency rule for now, but it's SUPER IMPORTANT FOR YOU TO GET THIS: This rule is making its way to becoming a "permanent rule." THIS IS NOT JUST FOR THE PURPOSE OF RIGHT NOW...OR, IN THE TIMES OF EMERGENCY.
THE PLAN IS TO MAKE THIS A PERMANENT RULE that will impact public and private places including: schools, churches, businesses, government offices, as well as indefinitely limiting the number of people at PRIVATE gatherings. At ANY TIME, the DHSS director or someone he directs, can declare another pandemic and suspend our constitutional rights.
SIDE NOTE: Did you know Missouri has a COO (Chief Operating Officer)? Yes, a bureaucrat running our state. Do you know what is worse? He has strong ties to McKinsey and Company. STRONG TIES. Do your own research and get a real beat on who this guy is and what McKinsey and Company is all about.

In Missouri COO's (Drew Erdmann) world, the new emergency rule and proposed amendment under the DHSS makes total sense. He lives in a shadowy world of control from behind the veil where consultants and NGOs inform decisions made on behalf of the electorate. As constituents and tax payers, we need to be aware of who is running our state. The "consent of the governed" matters. Your elected officials should care. McKinsey and Co. does not.
Ask yourself once you do your own research on McKinsey and Company how comfortable you feel with that kind of Communist China loving mentality running our state?
Why can't those elected make the decisions for our state in times of "crisis"? We have to protect the consent of the governed, not be forced to comply with policy promulgated by consulting firms.
Missouri wants our elected representation representing us, NOT unelected bureaucrats with agendas of their own.

Sections (3) and (4) would give an unelected person the power to declare a statewide pandemic, close public and private places indefinitely (including school and churches), limit the size of public and private gatherings, and limit the number of people in public and private gatherings. This violates my First Amendment rights to assemble and practice my religion and should not be allowed. Please withdraw this amendment.

UPDATE 5/11/20: JCAR member Ben Baker has submitted a letter to Dr. Randall Williams at DHSS regarding the proposed rule change. "...this to me and to many other Representatives and Senators is a substantial granting of unconstitutional power! We are asking DHSS to withdraw the rule or we will have hearings in JCAR to properly discuss the issue." You can find a copy of his comments and the letter here
